1. Acceptance of Terms

By accessing or using Astrotical ("the Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

These Terms constitute a legally binding agreement between you and Astrotical. Please read them carefully along with our Privacy Policy and Disclaimer.

2. Service Description and Intended Use

Astrotical provides AI-powered insights based on:

• Vedic Astrology (Jyotish)
• Numerology
• Vaastu Shastra
• Compatibility Analysis

You acknowledge and agree that you assume all risk for any decisions, actions, or consequences resulting from your use of Astrotical. The insights provided should never be the sole basis for important life decisions.

3. User Accounts and Eligibility

Age Requirement: You must be at least 18 years of age to use Astrotical. If you are under 18, you must have explicit parental or guardian consent and supervision.

Account Requirements:

• You must provide accurate, current, and complete information when creating an account
• You are responsible for maintaining the confidentiality and security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts that violate these terms
• One person may not maintain multiple accounts

4. Subscription and Payments

Astrotical offers multiple subscription tiers: Free, Premium, and Couples plans.

4.1 Billing and Pricing

• Premium subscriptions are billed monthly at the current advertised rate
• All payments are processed securely through Stripe
• Prices are subject to change with 30 days notice
• All fees are in USD unless otherwise stated

4.2 Automatic Renewal

By subscribing to a paid plan, you agree to automatic recurring billing. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

4.3 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation is effective at the end of the current billing period
• No refunds for partial months or unused time (except as stated in our Refund Policy)
• Upon cancellation, you will retain access until the end of the paid period

4.4 Refunds

Refund requests are governed by our Refund Policy. Generally, we offer a 7-day money-back guarantee for first-time Premium subscribers.

4.5 No Guarantees or Warranties of Predictions

5. Prohibited Uses

You may not use Astrotical to:

• Violate any local, state, national, or international laws or regulations
• Harass, abuse, threaten, or harm others
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Distribute malware, viruses, or engage in fraudulent activity
• Reverse engineer, decompile, or attempt to extract source code from the service
• Use automated systems (bots, scrapers) to access the service
• Attempt to gain unauthorized access to our systems or networks
• Resell, redistribute, or commercially exploit the service without permission
• Use the service to make critical life decisions without consulting professionals
• Share your account credentials with others

6. Intellectual Property

All content, features, functionality, software, designs, text, graphics, logos, and other materials of Astrotical are owned by us or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal, non-commercial purposes. This license does not include any right to resale or commercial use of the service or its contents.

7. User Content and Data

You retain ownership of any birth data, personal information, or other content you provide to Astrotical. However, by using the service, you grant us a license to use this data to provide and improve our services.

We handle your data in accordance with our Privacy Policy. You are responsible for the accuracy of any information you provide.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties that defects will be corrected
• Warranties regarding the results obtained from using the service

We do not guarantee the accuracy, completeness, or usefulness of any information provided through our service. Any reliance on such information is strictly at your own risk.

9. Limitation of Liability

In no event shall Astrotical, its owners, operators, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Personal injury or property damage
• Emotional distress or mental anguish
• Relationship difficulties or breakdowns
• Financial losses or missed opportunities
• Legal disputes or problems
• Any other losses resulting from your use of or reliance on the service

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

If we are found liable despite these limitations, our total liability to you for all damages, losses, and causes of action shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100 USD, whichever is less.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Material changes will be communicated through the service or via email.

Your continued use of Astrotical after any changes constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the service and cancel your subscription.

11. Indemnification

You agree to indemnify, defend, and hold harmless Astrotical, its owners, operators, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Any content or information you provide to the service
• Any decisions or actions you take based on insights from the service
• Any claims by third parties related to your use of the service

This indemnification obligation will survive termination of these Terms and your use of the service.

12. Arbitration and Dispute Resolution

12.1 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in the United States, or at another mutually agreed location. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Either party may seek equitable relief in court to protect intellectual property rights or to enforce the arbitration agreement. Additionally, claims may be brought in small claims court if they qualify under that court's rules.

12.4 Opt-Out Right

You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice of your decision to opt out to legal@astrotical.com with the subject line "Arbitration Opt-Out" including your name and account email.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Termination

We reserve the right to suspend or terminate your access to the service at any time, with or without cause, with or without notice, effective immediately. This includes termination for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Requests by law enforcement or other government agencies
• Discontinuation or material modification of the service
• Unexpected technical or security issues

Upon termination, your right to use the service will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to liability limitations, indemnification, and dispute resolution.

16. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and Refund Policy, constitute the entire agreement between you and Astrotical regarding the service and supersede all prior agreements and understandings.
